AN ACT TO CREATE A NEW CODE SECTION TO BE CODIFIED AS SECTION 77-3-12, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE PUBLIC SERVICE COMMISSION TO ISSUE COMPETING CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY TO GENERATE, TRANSMIT OR DISTRIBUTE ELECTRICITY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following provision shall be codified as Section 77-3-12, Mississippi Code of 1972:
77-3-12. The commission is authorized to issue more than one (1) competing certificate of public convenience and necessity to generate, transmit or distribute electricity in the same geographical area.
The commission shall adopt all rules and regulations necessary for implementing the issuance of competing certificates.
The commission retains the authority to issue orders to implement its rules, regulations and the provisions of this chapter, including the authority to grant and modify, impose conditions upon, or revoke a certificate.
SECTION 2. This act shall take effect and be in force from and after July 1, 1999.
